The Automatic Stay which is created when the case is filed not only stops foreclosures and repossessions, but also stops, lawsuits, service of process, wage garnishment and bank levy.
When the sheriff serves a bank levy on the bank, the bank must turn over whatever is in your accounts as soon as possible. Your accounts will show up zeroed out immediately. However, the bank may or may not turn the money over immediately. Assuming that the bank does turn it over to the sheriff immediately, the sheriff must wait ten days before sending it to your creditor.
If you file your case before the sheriff turns it over to the creditor, you have an excellent chance at getting your money back. Usually, you'll have to file some paperwork and get a court order to get the money back, but it's pretty routine and easy to do. You do have to be able to protect the amount of money taken under your state's laws in order to get it back though.

I've been a bankruptcy attorney in Temecula since 2007 and first started my bankruptcy practice in 1994. I do it to give you peace of mind. I do it to win. I love what it does for families, I love that it takes the biggest thing that couples argue about and tosses it out the window: Debt.
Filing Bankruptcy causes a court order to be issued immediately, it's a temporary restraining order called the Automatic Stay. It orders almost all creditors to cease collections. There are limited exceptions. For most creditors, if they know that you've filed a bankruptcy and continue collecting in spite of it, then that creditor is in wilful violation of the automatic stay. A creditor doesn't even have to know what the automatic stay is.
If a creditor willfully violates the automatic stay, it must pay your damages. If your car is repossessed wrongfully and you miss a day's work, your creditor owes you that day of pay. If the creditor not only knows about your bankruptcy but knows what the automatic stay really means, then that creditor may be required to pay punitive damages, & if the creditor doesn't know you've filed and takes your car, they still have to give it back!
Because the damages can be so severe for violation of the automatic stay, it means that bankruptcy stops foreclosure. If your house is foreclosed after your case has been filed, guess what, that creditor must un-foreclose it the following day.
If a creditor repossesses your car after your case is filed, even if the creditor didn't know that you have already filed your bankruptcy case, then the creditor must give you the car back.
When I first started out, a client who was getting a divorce, and was driving a car in her husband's name, had her car repossessed the day after her case was filed. Even though her name was not on the car, her community property interest in the car was protected by the automatic stay and within a couple hours, I had her car in my parking lot being dropped off at the creditor's expense.
If you've been to your bank and the accounts are all down to zero because of a bank levy, then your pay check is going to be garnished on your next pay day. It's time to file your Bankruptcy RIGHT NOW.
