    Hello. Trying to figure out to file BK and keep my current car. The issue with my car is that it is in my daughters name as well. So if I do go thru with BK and want the car included does that clear her also? or does she keep the car and still make payments but my name is off of the loan. Thank you for your time

      If you put a car into a bankruptcy, give the car back, quit paying it, and discharge it, while you’re safe, your cosignors will hear from the creditor soon enough about paying off the car. What some people do is ask the other cosignor if that person wants to take the car and take over the payments. But if they can’t and you want to protect the other person, then you have to figure out how to keep making the payments yourself. It’s a tough situation. Sometimes what we do is two (2) bankruptcies.
